1. Acceptance of Terms

By accessing and using ThetaDriven Coach ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.


2. Voice Call Services

ThetaDriven Coach provides AI-driven voice call services, including but not limited to:

  • Strategic Nudge calls to help users achieve personal and professional goals
  • Voice call testing features for users to experience the service
  • Friend referral voice calls (also known as "prank" or "poke" calls)
2.1 Consent and Authorization

By using our voice call features:

  • You consent to receive automated voice calls and text messages at the phone number you provide
  • You confirm you have the legal right to provide any phone numbers you submit
  • For friend referrals, you confirm you have permission from the recipient to share their contact information
  • You understand that standard message and data rates may apply
2.2 Friend Referral / Prank Call Feature

The friend referral voice call feature allows users to share the ThetaDriven Coach experience with others. By using this feature:

  • You represent that you have a genuine relationship with the recipient
  • You confirm the recipient would reasonably expect to receive communications based on your recommendation
  • You will not use this feature for harassment, spam, or any malicious purpose
  • You understand the recipient will be informed that you initiated the contact
  • You accept full responsibility for any consequences of initiating contact with the recipient
2.3 Opt-Out and Do Not Call

Recipients of voice calls can opt out at any time by:

  • Replying "STOP" to any text message
  • Requesting removal during any voice call
  • Contacting support at support@thetacoach.biz

3. Privacy and Data Protection

We are committed to protecting your privacy and comply with applicable data protection laws including GDPR (Europe) and CCPA (California).

3.1 Data Collection and Use

We collect and process:

  • Contact information (name, email, phone number)
  • Profile data you provide for coaching personalization
  • Voice call recordings for quality and improvement purposes
  • Interaction data to improve our Strategic Nudge algorithms
3.2 Your Rights

You have the right to:

  • Access your personal data
  • Request correction of inaccurate data
  • Request deletion of your data
  • Export your data in a portable format
  • Withdraw consent for data processing

4. CRM Subscription and Pricing
4.1 Subscription Tiers

ThetaDriven CRM offers three subscription tiers:

  • Explorer ($1/month per seat): Access to the complete V1 feature set, permanently. Community support via Discord.
  • Founding Member ($497/month per seat): Includes priority support and direct founder access. May receive updates and improvements at our discretion.
  • Enterprise Support ($2,500/month): Package including setup, coaching, and dedicated support. Service levels and features subject to agreement.
4.2 Payment Terms
  • All subscriptions are billed monthly in advance
  • Trial periods (if offered) are subject to terms at time of signup
  • Prices are subject to change with 30 days notice for existing customers
  • Explorer tier ($1/month): Access to the complete V1 feature set, permanently. V1 feature set is defined as features available at the time of your subscription. Future versions (V2, V3, etc.) may require separate subscriptions or upgrades.
4.3 Service Expectations
  • Explorer: Self-service with community support via Discord. No guarantee of uptime or availability.
  • Founding Member: Priority email support. Updates and maintenance provided on a best-effort basis. No guarantee of specific features or delivery timelines.
  • Enterprise: Dedicated support subject to service level agreement. Service availability and features as mutually agreed in writing.
4.4 Refund Policy

We offer a 30-day money-back guarantee for first-time subscribers. After 30 days, subscriptions are non-refundable but can be cancelled at any time to prevent future charges.

4.5 Data Ownership and Backup Responsibility

Your Database, Your Responsibility: You own 100% of your CRM data because it lives in YOUR Supabase/PostgreSQL database, not ours. We only connect to your database using credentials you provide.

CRITICAL: YOU ARE SOLELY RESPONSIBLE FOR BACKING UP YOUR DATABASE. We are not responsible for data loss, corruption, or unavailability in your database. This includes but not limited to:

  • Accidental deletion or modification of data in your Supabase instance
  • Database corruption, hardware failures, or Supabase service outages
  • Loss of access to your Supabase account or credentials
  • SQL queries or operations that you or we execute on your behalf that result in data loss
  • Any third-party service failures (Supabase, PostgreSQL, cloud providers)

Backup Recommendations: Supabase provides automated backups on paid plans. We strongly recommend enabling Point-in-Time Recovery (PITR) and regularly downloading backup files. You should maintain your own backup strategy independent of any third-party provider.

Data Export: Upon cancellation, you retain full access to your database as it belongs to you, not us. We provide SQL export tools for convenience, but your data remains in your Supabase instance regardless of your ThetaCoach subscription status.


5. CRM MCP Server Installation and Data Access
5.1 Local Installation

The ThetaCoach CRM uses a Model Context Protocol (MCP) server that installs locally on your computer. When you run the installation command:

  • Files are installed to ~/.config/claude/mcp-servers/thetacoach-crm
  • Your Supabase credentials are stored locally in ~/.thetacoach/credentials.json
  • No root/admin privileges required
  • Installation is reversible by deleting the directories above
5.2 Data Access and Privacy

Your Data Ownership: You own 100% of your CRM data. It lives in your personal Supabase database.

How We Access Data:

  • Direct Access (MCP): Your local Claude Code connects directly to your Supabase using your credentials
  • Web Dashboard: Our servers route requests to your Supabase instance using encrypted credentials stored in our database
  • API Routes: Server-side operations (email automation, webhooks) access your Supabase on your behalf
5.3 What We Do NOT Do
  • We do NOT read your CRM data without your explicit command
  • We do NOT train AI models on your data
  • We do NOT sell or share your data with third parties
  • We do NOT access your data for analytics without anonymization
5.4 Credential Storage

Your Supabase credentials are stored in two places:

  • Locally: Plain text in ~/.thetacoach/credentials.json (only you have access)
  • Our Database: AES-256 encrypted in our Supabase instance (for web dashboard and server operations)

You can revoke access at any time by rotating your Supabase service key or deleting your ThetaCoach account.

5.5 Open Source and Transparency

The MCP server installation script is publicly auditable at https://thetacoach.biz/api/mcp/install. You can review exactly what it does before running it.


6. Prohibited Uses

You agree not to use the Service to:

  • Harass, abuse, or harm another person
  • Violate any laws or regulations
  • Impersonate any person or entity
  • Send spam or unsolicited communications
  • Use the friend referral feature without genuine permission
  • Attempt to gain unauthorized access to our systems

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of ThetaDriven Coach and are protected by international copyright, trademark, and other intellectual property laws.


8. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, UPTIME, AVAILABILITY, DATA INTEGRITY, OR CONTINUED OPERATION.

WE DO NOT GUARANTEE ANY SPECIFIC UPTIME, AVAILABILITY, OR SERVICE LEVEL FOR ANY SUBSCRIPTION TIER EXCEPT AS EXPLICITLY STATED IN A SEPARATE SERVICE LEVEL AGREEMENT (SLA). THE SERVICE MAY BE INTERRUPTED, DISCONTINUED, OR MODIFIED AT ANY TIME WITH OR WITHOUT NOTICE.

ThetaDriven Coach is not a substitute for professional medical, psychological, or other professional advice. Always seek the advice of qualified professionals with any questions you may have.

7.1 Performance Claims and Results

Any performance improvements, time savings, or productivity gains mentioned in our materials (including but not limited to "30% faster," "47 days sooner," or similar claims) represent:

  • Potential results based on simulated testing and theoretical models
  • Average improvements observed in controlled environments
  • Results that may vary significantly based on individual circumstances, implementation, and use case

WE DO NOT GUARANTEE ANY SPECIFIC RESULTS OR IMPROVEMENTS. Individual results will vary based on numerous factors including but not limited to: your starting point, consistency of use, implementation quality, external circumstances, and personal commitment. Past performance or testimonials do not guarantee future results.

7.2 Patent and Technology Claims

References to our Fractal Identity Map (FIM) technology, pattern recognition capabilities, or any patented methods describe technical capabilities under specific conditions. Actual performance in production environments may differ from laboratory or simulated results.

IN NO EVENT SHALL THETADRIVEN COACH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.


9. Indemnification

You agree to indemnify and hold harmless ThetaDriven Coach, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising out of or relating to your use of the Service, including but not limited to your use of the friend referral feature.


10. Confidential Information and Research Papers
9.1 Proprietary Research Access

ThetaDriven Coach provides access to proprietary research papers, technical whitepapers, and defensive publications containing confidential and proprietary information. By accessing these materials through our authenticated systems, you acknowledge and agree that:

  • All technical papers, research documents, and whitepapers contain proprietary information covered under patent pending status
  • You agree to maintain strict confidentiality of all information contained in these documents
  • You will not distribute, share, copy, or reproduce any content without explicit written permission
  • All access is logged and monitored for security purposes
  • Violation of confidentiality terms may result in immediate account termination and legal action
9.2 Non-Disclosure Agreement (NDA)

By signing in and accessing research papers, you agree to the following confidentiality terms:

  • Confidential Information includes all research papers, technical documentation, patent claims, performance data, business strategies, and proprietary methodologies
  • Non-Disclosure: You will not disclose confidential information to any third party without prior written consent from ThetaDriven Inc.
  • Non-Use: You will not use confidential information for any purpose other than evaluation and understanding of our technology
  • Duration: These confidentiality obligations survive termination of your account and continue for 5 years or until information becomes publicly available through authorized disclosure

IMPORTANT: Your authenticated access to research papers constitutes acceptance of these NDA terms. If you do not agree to maintain confidentiality, do not access proprietary research materials.


11. Governing Law and Jurisdiction
10.1 United States Users

For users in the United States, these Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

10.2 European Union Users

For users in the European Union, these Terms shall be governed by the laws of Ireland, and you may have additional rights under your local consumer protection laws.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in the respective jurisdictions mentioned above, except where prohibited by local law.


12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
